STANDARD OPERATING PROCEDURE (SOP) FOR ENROLLMENT IN DOLA METHOD COURSE
1.Definitions:
For the purpose of this Standard Operating Procedure ("SOP"), the following definitions shall apply:
a) Participant: The term “Participant” refers to any individual who enrolls in the Course, accesses the Course materials, or otherwise engages with the educational content provided by the Course provider. The Participant acknowledges that they are entering into this agreement voluntarily and shall comply with all the terms set forth herein.
b) Course Provider: The term “Course Provider” refers to the entity, business, or individual responsible for creating, managing, and delivering the Course, including but not limited to overseeing Course materials, payment processing, and student support. The Course Provider holds all rights to the Course content and intellectual property.
c) Course Presenter: The term “Course Presenter” refers to the individual(s) responsible for delivering or facilitating the Course content, including providing instruction, guidance, or demonstrations during the Course. The Course Presenter may be the same as the Course Provider or a representative appointed by the Course Provider.
d) Course: The term “Course” refers to the educational program offered by the Course Provider, known as the Dola Method Course, which consists of pre-recorded training materials, instructional videos, and supplementary content made available to the Participant upon enrollment. The Course is intended for informational and educational purposes only and does not constitute professional financial, legal, or business advice.
These definitions shall apply throughout this SOP. Any references to these terms shall be interpreted in accordance with the meanings specified above.
2.Acknowledgment and Acceptance of Terms:
By enrolling in the Dola Method Course ("Course"), the student ("Participant") acknowledges and agrees to the terms set forth in this Standard Operating Procedure ("SOP"). Enrollment in the Course constitutes the Participant’s acceptance of these terms. The Participant understands that this SOP is legally binding upon acceptance and the Course provider reserves the right to update these terms from time to time. Continued participation in the Course after updates constitutes acceptance of the revised terms. The Participant should review this SOP periodically to stay informed about any changes and further acknowledges that they have had the opportunity to seek clarification regarding any term before accepting. No verbal or written statements outside of this SOP shall modify its enforceability. If any provision in this SOP is found unenforceable, the remaining provisions shall continue to be valid. The Participant agrees that failure to review updates does not exempt them from compliance.
3.No Guarantee of Results:
The Participant acknowledges that the Course is designed to provide educational content and guidance based on the experiences and strategies of the Course presenter. The Course provider makes no guarantees regarding the success, revenue generation, or specific financial outcomes that the Participant may achieve. Any earnings or success examples discussed during the Course are illustrative and should not be considered as promises or guarantees of actual performance. Results will vary based on individual effort, application of the knowledge, and external factors. The Participant is solely responsible for evaluating the suitability of the Course for their personal or professional goals. The Course provider disclaims any liability for any business or financial decisions made by the Participant. The Participant understands that testimonials and case studies presented in the Course are based on past results and may not be indicative of future outcomes. Any strategies taught are subject to changing market conditions, and their effectiveness cannot be assured. The Participant agrees that their level of diligence and consistency will significantly impact their success. The Course provider is not responsible for any Participant’s failure due to a lack of action or incorrect implementation of the material.
4.Individual Effort and Responsibility:
The Participant understands that their success in implementing the methods taught in the Course depends entirely on their personal effort, commitment, time investment, market conditions, and other external factors beyond the control of the Course provider. The Course provider shall not be held responsible for the Participant’s inability to achieve desired financial or business outcomes. The Course does not provide individualized financial, legal, or business advice. Participants should seek independent professional advice before making financial commitments. The Participant assumes full responsibility for the risks associated with implementing the Course materials. The Course provider does not guarantee any specific results and will not be held liable for any losses incurred. The Participant understands that taking action on the Course material requires consistent application over time. The Participant acknowledges that failure to properly implement the strategies taught does not constitute grounds for refunds or complaints. The Participant agrees that self-discipline and proactive learning are essential components of success. The Course provider is not liable for external economic conditions that may impact results. The Participant confirms they are not relying solely on the Course provider for financial decision-making.
5.Voluntary Enrollment:
The Participant confirms that they are enrolling in the Course voluntarily and that no coercion, misrepresentation, or undue influence has been exercised by the Course provider or its representatives to persuade the Participant to join. Any testimonials, case studies, or success stories provided are for illustrative purposes only and do not guarantee similar results. The Participant agrees that their decision to enroll is based solely on their personal evaluation of the Course. The Participant understands that they are free to discontinue the Course at any time, subject to the refund policy stated herein. The Participant further affirms that they have reviewed the pricing and Course structure before enrolling. The Participant agrees that they are responsible for ensuring their technological capability to access Course materials. The Course provider is not responsible for issues arising from the Participant's inability to use digital platforms. The Participant acknowledges that Course content delivery is standardized and cannot be modified to individual preferences. The Participant confirms that they have not been subjected to misleading or deceptive advertising.
6.No Legal Claims Against Course Provider:
The Participant agrees to hold the Course provider, its affiliates, representatives, and instructors harmless from any legal claims, disputes, or liabilities arising from their participation in the Course, including but not limited to claims related to dissatisfaction with the Course content, failure to generate revenue, or any financial losses incurred. The Course provider is not responsible for any indirect, incidental, or consequential damages arising from participation in the Course. The Participant agrees that any claim they may have must be brought within six (6) months of purchasing the Course with course provoider . The Participant further waives any right to participate in class-action lawsuits against the Course provider.The Participant understands that this waiver of legal claims is a material condition of their enrollment. The Participant acknowledges that they have received all relevant disclaimers before enrolling. The Course provider is not responsible for any interpretations or assumptions made by the Participant. The Participant agrees that disputes, if any, will be addressed exclusively through arbitration. The Course provider retains the right to seek legal costs from the Participant if an unsubstantiated legal claim is filed. The Participant confirms that they have read and understood this clause in its entirety.
7.Non-Refundable Fees:
All Course fees paid by the Participant are non-refundable, unless explicitly stated otherwise in the terms and conditions provided at the time of enrolment in annexure A. The Participant acknowledges that once access to the Course content is granted, the fee is non-refundable. Refund requests based on personal dissatisfaction, lack of time, or inability to implement the Course content will not be entertained. In the event that the Course provider offers a refund policy, it will be clearly outlined at the time of purchase. Chargebacks or disputes raised through payment processors may result in legal action. The Course provider reserves the right to terminate access to the Course for Participants who engage in fraudulent refund claims. The Participant understands that the Course provider incurs administrative and digital costs upon enrollment. The Participant agrees not to initiate chargebacks as a means to bypass the refund policy. Any breach of payment terms may result in legal consequences. The Participant understands that requesting a refund on false premises constitutes fraud. Refund policies are subject to jurisdictional laws governing consumer transactions.
8.Intellectual Property and Confidentiality:
All Course materials, including videos, documents, and strategies shared within the Course, are the intellectual property of the Course provider and are intended for personal use only. The Participant agrees not to copy, distribute, or share Course content with third parties. Unauthorized reproduction, resale, or dissemination of Course materials is strictly prohibited. Any violation of this clause may result in legal action and immediate termination of access to the Course. The Participant agrees to maintain confidentiality regarding proprietary strategies and methods taught in the Course.The Participant understands that the Course materials are protected under copyright and intellectual property laws. Any attempt to reverse-engineer, modify, or repurpose Course content for commercial gain is strictly prohibited. The Course provider reserves the right to pursue legal remedies, including but not limited to injunctive relief and monetary damages, for any infringement. The Participant agrees that all discussions, forums, or private community content associated with the Course are also protected under this clause. Any unauthorized sharing of internal discussions, strategies, or proprietary methods will be treated as a breach of confidentiality.
9.No Endorsement of Third-Party Services:
The Participant acknowledges that any third-party services, tools, or platforms recommended during the Course are suggestions based on personal experience and not formal endorsements. The Course provider is not responsible for the performance or reliability of any third-party service. The Participant assumes full responsibility for their use of third-party services and should conduct independent research before making any financial commitments. The Course provider does not receive commissions or affiliate compensation from third-party service providers. Any reliance on third-party tools is solely at the Participant’s risk.The Participant understands that any changes made by third-party service providers, such as pricing, availability, or functionality, are beyond the control of the Course provider. The Course provider shall not be held liable for any disruptions, technical failures, or financial losses caused by third-party platforms. The Participant is encouraged to review the terms and conditions of third-party providers before usage. The Course provider does not provide technical support or troubleshooting for third-party services. The Participant agrees to indemnify the Course provider against any claims, disputes, or losses arising from their interaction with third-party platforms.
10.Dispute Resolution:
In the event of any disputes arising from this SOP, both parties agree to first attempt resolution through amicable negotiations. If an amicable resolution is not reached, disputes shall be resolved through arbitration in accordance with applicable laws. Arbitration shall take place in the jurisdiction specified by the Course provider. The Participant agrees to bear their own costs in any arbitration proceedings. The decision of the arbitrator shall be final and binding on both parties.The Participant agrees that disputes shall be handled on an individual basis and waives the right to participate in any class-action lawsuits. Any legal proceedings initiated in violation of this clause shall be subject to dismissal. The Course provider reserves the right to seek recovery of legal fees if forced to defend against a claim brought in bad faith. If any provision of this clause is deemed unenforceable, the remainder of the clause shall remain in full effect. This clause does not prevent the Course provider from seeking injunctive relief for breaches of intellectual property rights or confidentiality obligations.
11.Compliance with Laws and Regulations:
The Participant agrees to comply with all applicable local, national, and international laws and regulations while participating in the Course. The Course Provider does not take responsibility for any legal violations committed by the Participant in their use of the Course materials or implementation of strategies learned. The Participant understands that certain business models or marketing practices discussed in the Course may be subject to specific legal requirements, such as tax regulations, consumer protection laws, or data privacy laws, depending on their jurisdiction. The Participant is solely responsible for ensuring that their actions align with applicable legal requirements. Any legal consequences arising from the Participant’s use of the Course content shall be their sole responsibility. The Course Provider reserves the right to terminate access to the Course if a Participant is found engaging in unlawful activities.
12.No Employment or Partnership Relationship:
Enrollment in the Course does not create any form of employment, joint venture, agency, or partnership between the Participant and the Course Provider. The Course is an independent educational offering, and the Participant is solely responsible for how they choose to implement the teachings. The Participant shall not represent themselves as an employee, affiliate, or authorized agent of the Course Provider. The Course Provider does not assume any responsibility for the Participant’s business dealings, customer interactions, or financial transactions. The Participant acknowledges that they do not have any authority to enter into agreements or make representations on behalf of the Course Provider. Any such unauthorized representation shall be considered a material breach of this SOP, resulting in immediate termination of Course access.
13.Technical Support and System Requirements:
The Participant acknowledges that access to the Course materials requires a stable internet connection and compatible electronic devices. The Course Provider is not responsible for any technical difficulties the Participant may encounter due to hardware failures, software incompatibilities, or insufficient internet connectivity. The Course Provider may provide basic troubleshooting assistance but does not guarantee uninterrupted access to Course content. The Participant is responsible for ensuring they meet the necessary technical requirements before enrolling in the Course. The Course Provider may update or modify the Course platform, which could lead to temporary service disruptions. The Participant agrees that such changes do not constitute grounds for refunds or compensation.
14.Termination of Access: |
The Course Provider reserves the right to revoke the Participant’s access to the Course at any time if the Participant violates any terms of this SOP. Grounds for termination include, but are not limited to, unauthorized distribution of Course materials, engagement in fraudulent activities, misuse of Course-related communities, or breach of confidentiality obligations. Termination of access shall be at the sole discretion of the Course Provider, and no refunds shall be issued in cases of violation. If access is revoked, the Participant must immediately cease using all Course materials and refrain from further distribution. The Course Provider retains the right to pursue legal action against any Participant engaging in activities that cause reputational or financial harm to the Course Provider. The Participant agrees to comply with any directives regarding the discontinuation of access upon termination.
15.Force Majeure:
The Course Provider shall not be held liable for any failure or delay in providing access to the Course due to unforeseen circumstances beyond its control, including but not limited to acts of God, natural disasters, war, labor strikes, power outages, cyber-attacks, pandemics, governmental restrictions, or technical failures. In the event of a force majeure situation, the Course Provider will make reasonable efforts to restore access to the Course as soon as possible. The Participant acknowledges that disruptions caused by force majeure events do not constitute grounds for refunds or compensation. If the Course is permanently discontinued due to a force majeure event, the Course Provider may, at its sole discretion, offer alternative arrangements or equivalent access to similar content. The Participant agrees that such arrangements shall be deemed sufficient to fulfill the Course Provider’s obligations under this SOP.
16.Data Handling and Privacy Compliance (As per Digital Personal Data Protection Act, 2023):
The Course Provider is committed to handling the Participant’s personal data in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable data protection laws. The Participant acknowledges and agrees that their personal information, including but not limited to name, email address, payment details, and usage data, may be collected, processed, stored, and used by the Course Provider for the purposes of Course administration, communication, and service improvement. The Course Provider shall implement appropriate security measures to protect the Participant’s personal data from unauthorized access, disclosure, or misuse. The Participant's data will only be retained for as long as necessary to fulfill the purposes for which it was collected unless required by law to be stored for a longer period. The Course Provider does not sell or share personal data with third parties for marketing purposes without the explicit consent of the Participant.The Participant has the right to request access, correction, or deletion of their personal data, as well as the right to withdraw consent where applicable, subject to legal and contractual obligations. Any such requests can be made by contacting the Course Provider through the designated channels provided in the Course terms and conditions. The Participant acknowledges that withdrawing consent may affect their access to certain Course features or services.In case of any data breaches affecting the Participant’s personal information, the Course Provider will take reasonable steps to notify the affected individuals and relevant authorities as required by the DPDP Act. By enrolling in the Course, the Participant consents to the collection and processing of their personal data as outlined in this clause.
17. Use of AI Tools and AI-Generated Content Disclaimer
The Participant acknowledges that the Course may utilize Artificial Intelligence (AI) tools, models, or automation technologies for content generation, assistance, or instructional purposes. While AI tools are designed to enhance learning efficiency and provide insightful recommendations, they are inherently imperfect and may produce inaccuracies, outdated information, or biased responses. The Course Provider does not guarantee the absolute accuracy, reliability, or completeness of any AI-generated content used in or provided as part of the Course.The Participant understands that AI-generated recommendations, text, or analysis should be independently verified before being acted upon, especially in financial, business, legal, or technical contexts. The Course Provider shall not be held liable for any direct or indirect consequences arising from the Participant’s reliance on AI-generated information. Any errors, misinterpretations, or omissions caused by AI tools do not constitute grounds for claims, refunds, or liability against the Course Provider. Furthermore, the Participant must not misuse AI tools provided within the Course for unethical, illegal, or deceptive practices, including but not limited to generating misleading advertisements, engaging in spam, or violating intellectual property rights. The Course Provider reserves the right to terminate access to the Course if AI tools are used in violation of ethical guidelines or applicable laws. By enrolling in the Course, the Participant acknowledges the limitations of AI tools, agrees to exercise discretion in their application, and releases the Course Provider from any liability related to AI-generated content, errors, or misjudgment.
Annexure A
General Terms and Conditions for the Dola Method Course
1. Non-Refundable Fees:
a) The course fee paid at the time of enrollment is strictly non-refundable under any circumstances.
b) Once access to the course materials has been granted, the participant will not be eligible for any refund or cancellation.
c) Refund requests based on personal dissatisfaction, lack of time, or inability to implement the course content will not be entertained.
d) Chargebacks or disputes raised through payment processors may result in legal action and permanent blacklisting from future courses.
e) The course provider incurs administrative and digital costs upon enrollment, making the fee non-refundable as per the standard policy.
2. Access & Usage:
a) The participant will receive access to the course materials for the duration specified at the time of enrollment.
b) All content, including videos, documents, and resources, is for personal educational use only and cannot be shared, copied, or resold.
c) Unauthorized distribution, reproduction, or sharing of course content in any form is strictly prohibited and may lead to legal consequences.
d) The course provider reserves the right to revoke access without prior notice if a participant is found violating the usage policies.
e) Any misuse of the course materials will result in immediate termination of access without any refund or compensation.
Course Outcomes & Results:
a) The course is designed for educational purposes, and results depend entirely on individual effort, commitment, and application.
b) The course provider does not guarantee any financial, business, or personal success upon completion of the course.
c) Any success stories, testimonials, or examples presented during the course are for illustrative purposes only and should not be considered as assured outcomes.
d) The effectiveness of the course depends on multiple factors such as market conditions, industry changes, and the participant’s dedication.
e) The course provider disclaims any responsibility for lack of expected results due to improper implementation of the content by the participant.
Technology & Support:
a) Participants are responsible for ensuring they have a stable internet connection and compatible devices to access the course materials.
b) The course provider is not responsible for any technical difficulties arising due to the participant’s hardware, software, or internet connectivity issues.
c) Basic troubleshooting assistance may be provided, but uninterrupted access to the course content is not guaranteed.
d) The course platform may undergo periodic updates or maintenance, which could lead to temporary access disruptions.
e) The course provider does not offer refunds or extensions for issues caused by personal device failures or internet service problems.
Conduct & Compliance:
a) Participants must maintain a professional and respectful attitude in any group discussions, forums, or interactions related to the course.
b) Any use of offensive language, harassment, or disruptive behavior will result in immediate removal from the course without any refund.
c) Participants must comply with all applicable local and international laws while using the course content and participating in discussions.
d) Any attempt to misrepresent the course provider, spread false information, or misuse the course materials will be subject to disciplinary action.
e) The course provider reserves the right to take legal action if any participant engages in unethical, fraudulent, or harmful activities.
Data Privacy:
a) The course provider collects and processes personal data only for administrative purposes, communication, and service improvement.
b) The participant’s data will be stored securely and will not be sold or shared with third parties for marketing without explicit consent.
c) The course provider follows the Digital Personal Data Protection Act, 2023, and other relevant privacy laws in handling participant data.
d) Participants may request access, correction, or deletion of their personal data as per applicable privacy regulations.
e) Withdrawing consent for data processing may result in limited access to course services, as some features require basic participant information.
Modification of Terms:
a) The course provider reserves the right to modify, update, or change these terms and conditions at any time without prior notice.
b) Participants will be notified of significant changes, and continued use of the course after modifications implies acceptance of the new terms.
c) It is the participant’s responsibility to review the terms periodically to stay informed about any updates.
d) The course provider is not liable for any misunderstanding or misinterpretation of the updated terms by the participants.
e) Any changes in pricing, content delivery, or course structure will be communicated in advance whenever possible.
Force Majeure:
a) The course provider will not be held responsible for any delays or disruptions caused by unforeseen circumstances beyond its control.
b) Such events include, but are not limited to, natural disasters, power outages, cyber-attacks, technical failures, pandemics, or government-imposed restrictions.
c) In case of such disruptions, reasonable efforts will be made to restore access to the course as soon as possible.
d) No refunds, extensions, or compensations will be provided for service interruptions caused by force majeure events.
e) If the course is permanently discontinued due to such an event, alternative access to similar content may be offered at the sole discretion of the course provider.
Support & Issue Resolution:
a) Participants who have concerns, questions, or face any issues with the course should first reach out to the course provider’s support team via the official contact details provided.
b) The course provider will make reasonable efforts to resolve any technical difficulties, content access issues, or general queries in a timely manner.
c) If a participant has a complaint regarding course content or policies, they may submit a formal request for clarification or resolution.
d) The course provider will review and address such concerns within a reasonable timeframe; however, decisions regarding refunds, access, or policy enforcement will be final.
e) Participants are encouraged to resolve any issues amicably with the support team before escalating matters further.
By enrolling in the Dola Method Course, the participant acknowledges that they have read, understood, and agreed to abide by these terms and conditions.
